yes, I'm inclined to agree, I've got a suit against them as well, that's been in deliberation in the 9th circuit now for like 380 days.. I called them up to ask what the status was recently and was told they're still considering it.. which was not what I expected to hear.. anyway this case as much as says that in the complaint
